Welcome to Tidy Design. "We", "us" and "our" refer to Tidy Design. We operate this store and website to provide you with a curated shopping experience (the "Services"). Tidy Design is powered by Shopify.
These Terms of Service ("Terms") describe your rights and responsibilities when using the Services. Please read them carefully — by visiting or using our Services, you agree to be bound by these Terms and our Privacy Policy. If you do not agree, please do not use our Services.
SECTION 1 — ACCESS
By using our Services, you confirm that you are at least the age of majority in your state or territory. You are responsible for ensuring that any minor dependents who use your account or devices do so with your consent.
You may be asked to provide information such as your name, email address, and payment and shipping details. You warrant that all information you provide is accurate, current, and complete.
You are solely responsible for the security of your account credentials and all activity under your account. Accounts may not be transferred or assigned to another person.
SECTION 2 — OUR PRODUCTS
Tidy Design products are made to order. Every item is produced specifically for you when you place your order.
We make every effort to accurately represent our products, including colours and sizing. However, colours may vary slightly depending on your screen settings and device. Product descriptions and images are subject to change without notice.
Please refer to our Size Guide before ordering. We recommend checking measurements carefully as we are unable to accept returns for incorrect size selection.
SECTION 3 — ORDERS
When you place an order, you are making an offer to purchase. Tidy Design reserves the right to accept or decline any order at its discretion. Your order is not accepted until we confirm it. Payment must be received and processed before your order is accepted.
Please review your order carefully before submitting. Because our products are made to order, we may be unable to accommodate cancellation requests once an order is accepted.
All purchases are subject to our Refund Policy. Products are for personal use only and not for commercial resale or export.
SECTION 4 — PRICES AND BILLING
Prices are displayed in your local currency and are subject to change without notice. The price charged is the price in effect at the time your order is placed, as confirmed in your order confirmation email.
Unless otherwise stated, prices do not include applicable taxes, duties, or import charges. Customers outside Australia are responsible for any customs fees or import duties that may apply.
You agree to provide accurate and complete payment information. By placing an order, you confirm you are authorised to use the payment method provided.
SECTION 5 — SHIPPING AND DELIVERY
All delivery timeframes are estimates from the date of dispatch and exclude production time. Please allow 1–5 business days for your order to be produced before dispatch. Tidy Design is not liable for delays caused by shipping carriers, customs processing, or circumstances outside our control.

SECTION 6 — INTELLECTUAL PROPERTY
All content on our Services — including trademarks, brand names, text, images, graphics, and designs — is owned by or licensed to Tidy Design and is protected by Australian and international intellectual property laws.
You may use our Services for personal, non-commercial purposes only. You may not reproduce, distribute, modify, or create derivative works of any material on our Services without our prior written consent.
Tidy Design's name, logo, and product names are trademarks of Tidy Design. You must not use these without our prior written permission.

We may provide access to third-party tools through our Services. These are provided "as is" and we accept no liability for your use of them. Use of any third-party tool is at your own risk.

SECTION 9 — RELATIONSHIP WITH SHOPIFY
Tidy Design is powered by Shopify, which enables us to provide the Services to you. All sales are made directly between you and Tidy Design. By using the Services, you acknowledge that Shopify is not responsible for any aspect of sales or transactions between you and Tidy Design. You expressly release Shopify and its affiliates from any claims arising from your purchases from Tidy Design.
SECTION 10 — PRIVACY
All personal information collected through our Services is handled in accordance with our Privacy Policy. By using the Services, you acknowledge that you have read and understood our Privacy Policy.

Nothing in these Terms excludes, restricts, or modifies any consumer guarantee under the Australian Consumer Law that cannot be excluded.
SECTION 18 — INDEMNIFICATION
You agree to indemnify and hold harmless Tidy Design, Shopify, and our respective affiliates, officers, employees, and agents from any claims, losses, or liabilities arising from your breach of these Terms, your violation of any law, or your use of our Services.
SECTION 19 — SEVERABILITY
If any provision of these Terms is found to be unlawful or unenforceable, that provision will be enforced to the maximum extent permitted and the remaining provisions will continue in full force.
SECTION 20 — ENTIRE AGREEMENT
These Terms, together with our Privacy Policy and any other policies referenced herein, constitute the entire agreement between you and Tidy Design regarding your use of the Services.
SECTION 21 — ASSIGNMENT
You may not transfer or assign your rights under these Terms without our written consent. We may transfer or assign our rights without notice to you.
SECTION 22 — GOVERNING LAW
These Terms are governed by the laws of Western Australia, Australia. You and Tidy Design submit to the non-exclusive jurisdiction of the courts of Western Australia for any dispute arising under these Terms.
SECTION 23 — CHANGES TO THESE TERMS
We may update these Terms at any time. Changes take effect when posted. Your continued use of our Services after any change constitutes acceptance of the updated Terms.
